ひろゆきは2ちゃんねる上に書きこまれたネット中傷に関連する多数の民事訴訟と多額の賠償債務を抱えている。訴えた人は、プロバイダ責任制限法のルールにそって、それぞれに損害や精神的な被害を与えた書き込みの削除を要請したのだが、それでも西村氏は削除しなかったのである。 あたかもプロバイダ責任制限法がなかったため、2ちゃんねるの問題投稿を削除しなかったかのような発言をしている。
このように、当時の2ちゃんねるの仕組みでは、名誉毀損などの無責任な言論による違法行為の責任を書き込んだ本人に追及することが不可能であったため、ユーザーは、自らの責任を問われることなく、権利侵害の発言を書き込むことが可能だった。 「削除ガイドライン」というものが名目上定められていたもの、裁判所には「内容が不明確であり、しかも、削除人は、それを業としないボランティアにすぎないことから、本件掲示板における発言によって名誉を毀損された者が、所定の方式に従って発言の削除を求めても、必ずしも削除人によって削除されるとは限らない」と認定されている。 -
